Dear Administrative Judges:
On September 21, 1989, we provided you with the schedule for completing the
- t.ff review of Rockwell International Corporation's renewal application. We have since been informed by Rockwell that after October 30, 1990, the only planned activities are to complete decontamination and decomissioning of the licensed facility.
Rockwell revised the renewal application, reducing the requested possession limits and changing the requested license term. Because of Rockwell's stated plans and in order to conserve staff resources, the staff does not plan to continue the review of Rockwell's renewal request or to issue a safety evaluation report or environmental assessment.
We have informed Rockwell that in accordance with 10 CFR 70.38, they should notify the Commission of their intent to terminate their license as of October 30, 1990. We have also requested Rockwell to either submit a schedule for submitting their decomissioning plan or the plan itself. Rockwell would continue to operate under the existing (e) cense until the requested termination li date.
In accordance with 10 CFR 70.38
, the license would continue in effect after the termination date with respect to possession of that residual special nuclear material present as contamination until the comission notifies the licensee in writing that the license is terminated.
Licensee actions would be limited to those related to decomissioning.
