The Staff also responds to "Intervenors' ltotion to Modify Hearing Schedule," (Intervenors' Hotion) filed by Joette Lorton end the Center for lluclear Responsibility on Decehiber 4, 1989.
By its Order of October 3,1989, the Licer sing Boarc set forth the hearing schedule for this proceeding, the parties were directed to file written testimony on December 18, 1989, and the hearing was scheduled to begin on January 10, 1990. Tte Intervenors' Motion requests that the Licensing Board reschedule the hearing date to accuniodate the limited period of availability of Dr. George Sih, the Intervenors' expert witness.
Apparently, Dr. Sih is av611able to participate in a hearing only between February 19 6no March 2,1990. On December 8, 1989, " Licensee's Response to Intervenors' Hotion to Modify Hearing Schedule" (Licensee's Response) was filed by the Licensee. The Licensee has no objection to Intervenors' Notion provideo 1) the Licensee has an opportunity to depose Dr. Sih and l

- 2) the oote for filing written testimony is changed. The License also proposed a revised hearing schedule in its Response.

The Staff requests a modification in the hearing schedule. The Staff requests that written testimony be filed after the Licensing Board issues an order on the Licensee's Motion for Summary Disposition and 15 days after the Staff has an opportunity to depose Dr. Sih. We also request that written testimony be filed at least 15 days prior to the start of the hearing.
The Staff has no objections to Intevenors' Motion, provided the testimony filing date is deferred end the Staff is given an opportunity to depose Dr. Sih prior to filing testimony.
The Licensee has agreed to our Motion provided the schedule set for the filing of testimony is the same for all the parties.
The Staff joins the Licensee in requesting that the Licensing Board schedule a conference call at its earliest convenience to allow the parties to comment on and discuss these issues and the issues raised in Intervenors' Notion and Licensee's Response.
