This letter acknowledges receipt of your letter of October 2,1989 and check for $25,000 in full payment of the civil penalty proposed by the NRC on August 31, 1989. The corrective actions described in your letter will be evaluated during future inspections to determine wnether additional enforcenent action is necessary.

In your response, you questioned whether the civil penalty should be assessed equally among the violations as stated in the Notice of Violation and Proposed Imposition of Civil Penalty, since that would cause the transportation violation under Supplement V to be assessed an aliiount greater than the amount set forth in Table 1A of the NRC Enforcement Policy.

In this case, the NRC could have issued a $2 500 civil penalty for the transportation violations, as well as a !25,000 civil penalty for the health physics violation that contributed to the transport-ation violations.

However, tie NRC chose to aggregate the violations to focus on the root cause and to not issue a separate $2,500 for the transportation violations since they were the consequence of the earlier loss of control of radioactive material.

Based upon your comprehensive corrective actions for the loss of control of radioactive material, no further action is planned at this time.
