Dear Mr. Borgmann:

As a result of a recent meeting with members of your st'aff to discuss the revised guard training plan we have reviewed the provisions of 10 CFR 73.55 as regards implementation of and compliance with training and qualifications plans to meet requirements cf 573.55(b)(4).

The portions of the general paragraph of 10 CFR 73.55 relevant to implementation and compliance read:

... Each applicant for a license to operate a nuclear power s

reactor pursuant to Part 50 of this chapter whose application was submitted prior to February 24, 1977, shall submit by May 25, 1977, an amended physical security plan describing how the applicant plans to comply with the requirements of this section including schedules of implementation.

If such applicant received an operating license after February 24, 1977, he shall comply with the requirements of paragraphs (b), (d), (f), (g) and (h) of this section,... by May 25, 1977, or on the date of receipt of the operating license, whichever is later and implement his plan and comply with the requirements of this section by February 23,1979, or on the date of receipt of the operating license whichever is later."

It is our conclusion that the Guard Training and Qualification Plan required under 173.55(b)(4), for the Wm. H. Zimmer Nuclear Power Station shall be implemented so as to provide for qualified guards as of the date of receipt of the operating license.

The implementation dates contained in section 173.55(b)(4) were intended to apply only to operating reactors, not to applicants with sufficient lead time available to them to commence operations with trained and qualified guard forces.
