APPENDIX A NOTICE OF VIOLATION Power Authority of the State of New York Docket No. 50-323 FitzPatrick Nuclear Power Station License No. DPR-S9 As a result of the inspection conducted on October 25 - November 30, 1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:
A.
Technical Specification 6.8(A) states, in part, " Written procedures and administrative policies shall be established, implemented and maintained...".
Work Activities Control Procedure No.10.1.6, Control of Modifications, Revision 4, dated December, 1979, states in part in paragraph 7.1.6.4, "The responsible individual shall follow the implementation to completion ensuring the installation is completed and tested in accordance with procedures."
Contrary to the above, modification FL-80-01 was not fully implemented in that Part B of Preop 02A, Acoustical Valve Monitoring System Checkout Procedure, dated June 24, 1980, was neither revised as indicated in PORC Meeting Review Minutes80-045 dated June 24, 1980 nor completed prior to declaring the acoustical valve monitoring system operable.
Work Activities Control Procedure No.10.1.6, Control of Modifications, Revision 4, dated December 1979 states in part in paragraph 7.1.7.2
" Controlled drawings affected by modification implementation shall be marked by the document coordinator so that a user is immediately aware that revisions are necessary to drawings for accurate representation of current system status."
Contrary to the above, the controlled copies of FM-17A-14, Radwaste System, dated September 17, 1976, have not been marked to indicate that changes are required as a result of modification FL-78-30.
This is a Severity Level V Violation (Supplement I).
B.
Technical Specification 6.11 states in part, " Procedures for personnel radiation protection shall be prepared and adhered to for all plant operations."
Radiation Protection Operating Procedure III.C.1, Personnel Monitoring for t
l Contamination, dated December 26, 1979, states in part, "A count rate meter is used by personnel when they axit from contaminated areas to ensure that they are not carrying contamination with them...The monitors are set up, calibrated and the alarm point set by rad protection...At access points to and from restricted areas every effort is made to locate the frisker such that it can be used on the XI range."

1 Contrary to the above, on October 31, 1980, the NRC inspectors observed contractor personnel exiting the Reactor Building track bay door, an exit from a contaminated area where no count rate meter was set up or used.

C.
Technical Specification 6.8(a) states, in part, " Written procedures and administrative policies shall be established, implemented and maintained...".
i Surveillance Procedure F-ST-98, EDG Full Load Test, Revision 7, dated June 11, 1980, Step V.2, states, " Ensure the doors between the DG Rooms are closed when the DG's are required to be operable."
Contrary to the above, the door between the EDG Switchgear Rooms DG 272/2 was left open on November 10, 1980 at the conclusion of the EDG Full Load Test.
This is a Severity Level V Violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, the Power Authority of the State of New York is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
