APPENDIX B NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket Nos. 50-317 50-318 Based on the results of the NRC inspection conducted May 12-23, 1980 it appears that certain of your activities were not conducted in full compliance with NRC regulations as indicated below. These items are infractions.

1.

10 CFR 20.201, " Surveys" requires the licensee to make or cause to be made surveys as may be necessary to comply with the regulations contained in 10 CFR 20.

Contrary to this requirement, surveys were not performed on the following days sufficient to assure compliance with 10 CFR 20.101 and 10 CFR 20.202 which prescribe the quarterly limits to which personnel are permitted to be exposed (in the circumstance when appropriate personnel monitoring equipment is not worn).

Portable instruments (PNR-4) used to perform surveys to determine neutron dose equivalent for workers in the Reactor Building were not calibrated so as to assure that the instruments would respond accurately in a neutron field, and, thereby, the surveys did not provide assurance that the neutron dose equivalent had been adequately measured.

10 CFR 71.3, " Requirement for license", states, "No licensee subject to the regulations in this part shall (a) deliver any licensed materials to a i

carrier for transport or (b) transport licensed material except as author-l ized in a general license or specific license issued by the Commission, or as exempted in this part."

10 CFR 71.12, " General license for shipment in DOT specification containers, in packages approved for use by another person, and in packages approved by a foreign national competent authority", states, "A general license is hereby issued to persons holding a general or specific license issued pursuant to this chapter, to deliver licensed material to a carrier for transport, provided the licensee has a quality assurance program, whose description has been submitted to and approved by the Commission as satisfying the provisions of 10 CFR 71.51."

10 CFR 71.51, " Establishment and maintenance of a quality assurance pro-gram," states, "The licensee shall establish, maintain and execute a quality assurance program satisfying each of the applicable criteria specified in Appendix E, ' Quality Assurance Criteria for Shipping Packages for Radioactive Material,' and satisfying any specific provisions which are applicable to the licensee's activities including procurement of packaging."

Contrary to 10 CFR 71.12, since January 1,1979, licensed material had been delivered to a carrier for transport but a quality assurance program satisfying the provisions of 10 CFR 71.51 had not been established, maintained and executed sufficient to meet the applicable criteria of Appendix E, " Quality Assurance Criteria for Shipping Packages for Radioactive Material."
