Significant Deficienty 80-03 Gentlemen:

Refer to your letter dated March 5, 1981, on the subject of an NRC Independent Nondestructive Examination of the Beaver Valley 2 Neu.ron Shield Tank at - the Babcock'& Wilcox facilities in Mt. Vernon, Indiana. Following initial conversations with our Principal Inspectcr, Mr. R. Feil, March 10, 1981, a telephone ' conference call was arranged on March 12, 1981, between Messrs.

Sanders and Walton of the NRC and repr :dentatives of Stone & Webster, Babcock &

Wilcox and ourselves.

' conference call, we are transmitting to Mr. Thomas T. Martin, Chief, Engineering Inspection Branch, the procedures and drawings' referenced in your letter under separate cover at a later. date. Appendix 1 to this letter shows the . details of

.the procedures and drawings originally and previously used for the examination of this~ vessel, and comments that may assist your staff in their review and use.

During the conference call, the present situation'of the vessel was discucsed in detail;-in summary, the vessel is considered to be inaccessible for

'the type of independent NDE examinations described without an adverse impact on the production activities. It is heavily scaf folded both inside the vessel and

. condition for a considerable period of time.

We considered that there would be a suitable time frame between the end of the basic repair activity and the post-weld heat treatment phase. During this period, our Contractor will be performing repairs designated by Noncon-formance and Disposition Reports initiated at the Beaver Valley Unit 42 Site.

During this time frame, the vessel will not be subject to continual preheat conditions and will also be more suitably scaf folded for your staff to perform the examinations they require.

Our basic estimate of the time frame at the time of the conference was sometime in August, 1981. We would emphasize, however, that this time frame could move to an earlier date, dependent upon the progress made by our Contractor, or a later date, dependent upon problems being found during the repair process. It was our understanding that subject to concurrence by the appropriate departmental management at the NRC, two weeks' notice of such a change in tine frame would be sufficient for your NDE group to be assigned to the Mt. Vernon ficility.

During the conference call, various possible contractual and/or legal problems were briefly discussed. These problems relate to local agreements entered into by our Centractor, radiation safety during any radiography performed by your group, associated liabilities, scheduling, and other related matters. In consequence, a letter has been transmitted to Babcock & Wilcox on March 18,1981, formally advising them of your intentions, and requesting them to provide us with any concerns with respect to commercial, legal and scheduling considerations relative to your activity. On receipt of their response and position, any problems they foresee will be reviewed by us and, if necessary, brought to your attention for discussion and mutual resolution.

As discussed in the conference call, we reiterate the importance of the installation of the repaired vessel; st is a controlling activity on the critica1' path of the project. Currently, we intend to move the vessel directly from the point of barge delivery to its final installed location. For this reason it is essential that the maximum coordination between the parties involved is achieved, and we will assist in any way in optimizing the coor-dination of your intended NDE activities to prevent any delay to the project.
