' 9'f b My letter to you dated May 15, 1980 enclosed the " Graduated Rescission of Order dated August 15, 1979" and the guidelines (in the Appendix to the Graduated Rescission) for a controlled, stepwise resumption of activities at the Marble Hill site when certain prerequisites had been met.
I have received your letter dated February 27, 1981 requesting rescission of the' Order dated August 15, 1979 in accordance with the guidelines referenced above.
Specifically, you stated t'at those activities identified in A, B, 0 and E of the " Graduated Rescission of the Order dated August 15, 1979" necessary to authorize resumption of construction by the Gust K. Newberg L
Construction Company (Newberg-Marble Hill) had been completed.
You requested written permission as required by Section E.3 of the referenced guidelines to

allow resumption of civil / structural work by Newberg-Marble Hill.
i Pursuant to the NRC hold points in B.7, C.3 and_D.3 of the restart program, NRC inspectors have inspected adjustments by Newberg-Marble Hill that satisfy i-items B.5, B.6, C and D of the referenced program.
Activities identified in item E.2a had been initiated and have been in progress since the termination of construction work. The program adjustments required under items E.2a and E.2b have been satisfactorily performed by Newberg-Marble Hill.
Based on the inspection findings by Region III, which confirm the information reported in your February 27, 1981 letter, I have concluded that the prerequi-sites necessary for resumption of civil / structural work, including receipt inspection, by Newberg-Marble Hill have been completed satisfactorily.
Accordingly, Public Service Company of Indiana (PSI) is authorized to allow Newberg-Marble Hill to resume construct,'on work in the specific disciplines for which Newberg-Marble Hill was contracted, subject to the following conditions:
1.
The evaluation of concrete patches and necessary repair shall be exp.fited.
2.
Initial repair areas shall be those that have been selected by NRC.

No construction work shall be resumed that would cover up concrete areas not yet adequately evaluated and repaireo to the satisfaction of NRC Region III.
This authorization is consistent with pa agraph E.3 of the Appendix to the " Graduated Rescission of the Order dated August 15, 1979."
The final rescission of the Order of August 15, 1979 will be made by this office after PSI has resumed construction and the Region III staff has determined that you have adequately implemented your commitments made in response to the Order.
