Dear Senator Hollings:

This is in response to your letter dated February 27, 1981, to !!r. Kammerer, Director, Office of Congressional Affairs, Nuclear Requlatory Connission UEi, regarding correspondence addressed to you from Mr. J. W. Cox of Rock Hill, South Carolina.

In his letter ifr. Cox supported the licensino of the ficGuire Huclear Station located in Mecklenburg County, North Carolina.

The McGuire Nuclear Station Unit I was issued a Fuel load and Zero Power License in January 1981.

The next phase in the startup prograa for full power operation is low power testing and power ascension.

lhe eatlic,t l i cenwe (Duke Power Company) schedule for this activity is July 1981 predicated on all required events including testing to occur without delay.

However, there remain several matters requiring a prompt satisfactory response from the licensee.

Our review (issue of a final Supplement to ou. Safety Evaluation Report) to support a full power operating license is expecte ! to be completed by April 1981.

As you may be aware, the public hearing before the Atomic Safety and Licensino Board ( ASLB) has been reopened by the ASLB in responsa to a motion filed by the intervenor on the basis of new information resulting from the I :1 accihnt.

The hearing was reopened in February 1981 and is continuing in Itarch.

A decisinn by the ASLB may occur in July 1981.. This will be followed by a review by the Atomic Safety. and Licensing-Appeal Board.

Under present rules, the full Commission would then perform its own review. A full power operating license might be issued for McGuire Unit 1 in November or December in81.

Upon issuance of our final Supplement to our Safety Evaluati. n Report (relatino to a full power operating license), it is possible that a fu ther motion to reopen can be filed on the basis of new information disclose. by the staff SER.

If such an additional hearing is required, the issuance of tre full power license could be delayed well into 1982.

4 The McGuire Nuclear Station, Unit 2 is projected to receive in operatinq license in 1982.

The above process is not expected to impac1* the issuance of'the Unit 2 operating license.
