In an Order to Modify License ("the Order"), dated February 11, 1981, found in 46 Fed. Reg.12566 (February 17, 1981), the Nuclear Regulatory Commission directed Combustion Engineering, Inc. ("the licensee") at Hematite, iiissouri, which is a holder of Special Nuclear ftaterial License No. S?!!1-33 ("the license") to submit within 180 days of the effective date of the Order, either a radiological contingency plan and an appli-cation for license anendment to incorporate the plan, as a conditica of the license or alternatively an application for license amendment to reduce the possession limits for radioactive materials below specified quantities.
By letter dated April 8,1981, the licensee requested an extension of time for submitting the radiological contingency plan to January 31, 1982, to coincide with the licensee's subnittal of a renewal application for the license. The reason given for the requested extension was that the licensee would be involved in concurrant preparation of two extensive documents for submittal to the NRC.
The licensee should upgrade its existing emergency plan to conform to the guidance contained in Enclosure 1 to the Order at an early data.

. those sections dealing with site and facility descriptions, process and manufacturing systems, equipment arrangement, and engineered provisions for abnormal operations can most effectively be prepared by the licensee and reviewed by the NRC if the submittals are prepared concurrently. The requested extension should not affect emergency pre-paredness at the Hematite site because of the currently approved site emergency plan. The Director, therefore, has determined that there is a good cause for modifying the Order and granting an extension of time to permit submittal of the radiological contingency plan at the same time as the renewal application.

Accordingly, pursuant to sections 161b and 161o of the Atomic Energy Act of 1954, as amended, 940.41(e) of 10 C.F.R. Part 40,970.32(a)(8),
(b)(2), and (b)(5) of 10 C.F.R. Part 70, and 92.204 of 10 C.F.R. Part 2, IT IS HEREBY ORDERED that the time within which the licensee shall submit t

a radiological contingency plan, pursuant to the Order dated February 11, i
1981, shall be extended to January 31, 1982. The Order, except as modified herein, remains in effect in accordance with its terms.
III.
The licensee or any person who has an interest affected by this Order may request a hearing within 25 days after issuance of this Order. A request for a hearing shall be submitted to the Director, Division of Fuel Cycle and Material Safety, U. S. Nuclear Regulatory Commission, l
. Washington, D. C. 20555.
Copies shall also be sent to the Secretary of the Coamission and the Executive Legal Director, at the same address.
If a person other than the licensee requests a hearing, that person shall describe, in accordance with 10 C.F.R. 2.714(a)(2), the nature of the person's interest and the manner in which that interest is affected by this Order.
If a hearing is requested by the licensee or other person who has an interest affected by this Order, the Commission will issue an order designating the time and place of the hearing.
If a hearing is held, the issue to be considered at the hearing shall be whether the licensee should be granted an extension of time to January 31, 1982, within which to comply with the Order dated February 11, 1981.
If a hearing is not requested, this Order will become effective 25 days from the date of this Order.
If a hearing is requested, this Order will become effective on the date specified in an order maae followin, the hearing.
