O Appendix A NOTICE OF VIOLATION Public Service Company of Colorado Docket No. 50-267 OPR-34 As a result of the inspection conducted on March 16-18, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violation was identified:

Failure to Provide Prompt Notification of Operability Evaluation Technical Specification 7.5.2.a.9 requires that the discovery during plant life of conditions concerning the performance of structures not specifically considered in the FSAR or Technical Specifications which require remedial action or corrective measures to prevent the existence or development of an unsafe condition be reported as expeditiously as possible, but within twenty-four hours, to the NRC.

IE Bulletin No. 80-11, issued May 8,1980, required a re-evaluation of the design adequacy of those masonry walls which are in proximity to or have attachments from safety-related piping or equipment such that wall failure could affect a safety-related system.

The Bulletin required a description of the systems and equipment, both safety and nonsafety-related, associated with those masonry walls.

The Bulletin also stated that if in the course of the re-evaluation the operability of any safety-related system were found to be in jeopardy, the licensee would be expected to meet the applicable Technical Specifications action statement.

Contrary to the above:

Through discussions with cognizant personnel and from the review of the licensee's response and supporting data to IE Bulletin 80-11, it was determined by the NRC inspector that those systems associated with the sixteen masonry walls found to be structurally inadequate were not described, analyzed for operability, and subsequently reported to the NRC.

This is a Severity Level IV violation.

(Supplement I, paragraph 0) i Pursuant to the provisions of 10 CFR Part 2.201, Public Service Company of Colorado is hereby required to submit to this office within 25 days of the date of this Notice, a written statement or explanation in reply, includina:

(1) the corrective steps which have been taken and the results achieved; (2) corrective actions which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Under the authori ty of Section 182 of the Atomic Enargy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
