I, Harold Bernard, being duly sworn do hereby depose and state the following:

1.

I am employed by the Nuclear Regulatory Commission as project nanager for the UCLA research reactor, in the Commission's Office of Nuclear Reactor Regulation, Division of Licensing.

2.

The purpose of this affidavit is to answer the interrogatories propuJnded to the Staff by the Regents of the University of California.

3.

My responses are the following:

Interrogatory 'lo. 1.

Yes. By letter dated June 13, 1979, the NlfC informed the University of California that their operat-ing license would expire March 30, 1980. There was enclosed with the letter a packet of material entitled " License Renewal Items" that consisted of guidelines and examples of material that should be included in the application for the renewal of the UCLA reactor license.

Yes.

I sent these questions to Applicant and received answers to all questions.

Interrogatory No. 3.

No. The Staff was not misled.

Interrogatory No. 4.

No.

Interrogatory No. 5.

No. The only Class 103 research reactors are owned by conaercial corporations.

Interrogatory No. 6.

No. The Staff does not so contend.

Interrogatory No. 7.

No. The Staff does not so contend.

Interrogatory No. 8.

No. The Staff does not so contend.

Interrogatory No. 9.

No. The Staff does not so contend.

Interrogatory No. 10.

Yes. All Argonaut reactors are similar in design and safety features.

Interrogatory No. 11.

No. The Staff is not aware of significant safety problems in Argonaut reactors.

Interrogatory No. 12. Yes. The Staff believes the Univers'1ty of California could obtain the funding necessary for operation of the UCLA research reactor and that it now possesses funds in the amount necessary for this purpose.

Interrogatory No.13. No.

Licensees of reactors are not required to consider sabotage as a design basis " accident".
