Dear Dr. Williams:

I an in receipt of your mimeographed letter dated May 8, 1981, entitled

" Support for True Intervenorship"; I understand that you have forwarded copies of that letter to the members of the Atomic Safety and Licensing Board

(" Licensing Board") and to the parties in the above captioned proceeding.

I wish to respond as follows.

First, neither the NRC Staff (' Staff"), nor I as Counsel for the Staff, is able to " authorize" contentions or stipulations. That is a function reserved, by !1RC regulation, for the Licensing Board. As you know, SEACA's revised con-tentions and the stipulation reached by SEACA, the Applicant and the Staff have been filed with tce Licensing Board. To date, the Licensing Board has not ruled upon the admissibility of SEACA's contentions or the stipulation.

Secondly, the Staff has already discussed SEACA's contentions at length with Julian McPhillips, Esq., who is, as far as we know, the only person authorized by SEACA to represent that organization and its members in this proceeding.

The Staff will continue to communicate with SEACA in this proceeding through Mr. McPnillips and will consider only those communications which are trans-mitted to us by Mr. McPhillips as having been authorized by SEACA.

Accord-ingly, I am unable to comply with your request that SEACA's contentions be reworded to include your " conference and mimeographed input". Any comments which you may have concerning SEACA's contenti]ns or its participation in 8105180 "O

-2 this proceeding should more properly be addressed to Mr. McPhillips; similarly, any connunication to the Staff from SEACA should be transmitted to us by Mr. McPhillips.
