Dear Mr. Linder:
By letter dated March 19, 1981, you requested an exemption to 10 CFR 50, Appendix R, Item 111.0 for,the Lacrosse Boiling Water Reactor (LACBWR).
This exegtion would remove the requirement for an oil collection system in the Reactor Coolann Pump (RCP) bay based on the substitution of a non-flammable fluid in the Forced Circulation Pump (Reactor Coolant Pump)
Coupling Oil System thereby reducing the quantity of flamable oil by about 90% to 15 gallons for each of the two pumps. Therefore, you assert that these measures would provide adequate fire protection.
You also requested an exemption to 10 CFR 50, Appendix R, Item III.A. This exemption would remove the requirement for an additional fire pump since you have already installed a new Emergency Service Water Supply System (ESWSS) and plan to upgrade the existing Fire Pugs by the addition of a sixth impeller stage to each pump. Therefore, you assert that the existing water supplies with modifications to the ESWSS meet the intent of Appendix R Item III.A and that another fire pump is not justified.
You should note that 10 CFR 50.48(c)(6) states that requests for exemptions from the requirements of Appendix R must assert either that the Appendix R require-ment would not enhance fire protection safety at the facility or that implementa-tion of the requirement would be detrimental to overall facility safety. Your letter does not explicitly make either assertion. We assume that you intend to rely on the first of these criteria, and will review your request on that basis.
If you also wish to rely on the second criterion, you should supplement your exemption request imediately.
On this basis we find that your requests provide sound technical basis warranting further staff review.
The schedule requirements for these items are, therefore, suspended in accordance with 10 CFR 50.48(c)(6) until final Commission action on these requests.
