Part 2.
As you know, Appendix B suspends 30 C.F.R. 1 2.764 which provides for the immediate effectiveness of certain initial decisions of Licensing 30ards.
The Licensing Board's !!ecorandum and Order generally adopted the position presented to the Licensing doard by the NRC Staff in support of Duke Power's notion. The Licensing Board found that Duke had made a prina facie showing of special circunstances such that application of 10 C.F.R. Part 2. Appendix B, would not serve the purpose for wnich the rule (10 C.F.R., Part 2, Appendix B) was adopted, viz., increased Commission supervision while avoiding undue delay and duplication of effort by adjudicators and parties.

MEMORANDUM AND ORDER (Certifying a Matter Directly to the Commission Pursuant to 10 C.F.R. 52.758)
On March 26, 1931, Duke Power Company (Applicant) filed a motion entitled " Applicant's Request for Saiver. Exception or E::emption from the Full Provisions of Appendix B to 10 C.F.R. Part 2" in the above-identified proceeding. The motion, which was accompanied by the affidavit of A. C. Thies, seeks a waiver, pursuant to 10 C.F.R. 5 2.758, of the appli-cation of the provisions of 10 C.F.R. Part 2, Appendix B in this proceeding, or alternatively a partial waiver to eliminate the requirement for indepen-dent review by the Appeal Board.
