Gentlemen:

This refers to the investigation concucted by Messrs. R. K. Herr., Peter Saci,

J. Tapia, and J. Gagliardo of our staff on March 29-April 10,1981, at

your facility in Bay City, Texas, concerning allegations dealing with intimida-

tion, unqualified personnel, concrete irregularities, insoection errors, and

conspiracy to obstruct an NRC inspection / investigation at your facility.

The

investigation and our findings are discussed in the enclosed investigatien

report.

In accordance with Section 2.790 of the Ccmmission's " Rules of Practice,"

Part 2, Title 10, Code of Federal Regulations, a cooy of tnis letter together

with the enclosed investigation report will be placed in the Ccmmission's

Public Document Room.

If this report contains any information that you

believe to be procrietary, it is necessary that you make a written apolica-

tion to this office witnin 25 days of the date of this letter requesting

that such information be withheld from public disclosure.

Any such acclica-

tion must include a full statement of the reasons on the basis of whicn it

is claimed that the information is proprietary, and should be prepared so

that croprietary infonnation identified in tne application is contained

in a separate part of the document.

If we do not hear from you in this

regard within the s;:ecified period, the report will be placed in the Public

Document Rocm.

Should you have any questions concerning this investigation, we will be

pleased to discuss them with you.
