On March 2,1981, NRC staff attempted a review of your Emergency Prepared-ness Plan, which was to be submitted by January 2, 1981, in accordance with 10 CFR 50.54(u). As you are aware, the plan has not been submitted and your revised submission dates of February 2 and March 2, 1981, have also passed.

Accordingly, as a result of review of our records and subsequent conversa-tion with your staff on March 2 and 5, 1981, it appears that your activities are in noncompliance with NRC requirements, as described in the enclosed Appendix A.

A written response is required.

In addition, we point out that 10 CFR Part 50 Appendix E, V, requires in part...

"all Nuclear Power Facility Licensees to submit Emergency Plan implementing procedure on or before March 1,1981, and further 10 CFR 50.54(s)(2) requires Emergency Plans to be implemented by April 1, 1981." We shall review the submission of these procedures and the implementation of your emergency preparedness program in the near future.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter, the enclosures, and your response to this letter will be placed in the NRC's Public Document Room, except as follows.

If the enclosures contain information that you or your contractors believe to be proprietary, you must apply in writing to this office, within twenty-five days of the date of this letter, to withhold such information from public disclosure.

The application must include a full statement of the reasons for which the information is considered proprietary, and should be prepared so that proprietary information identified in the application is contained in an enclosure to the application.
