Dear Dr. Williams:

I am in receipt of your letter, dated February 13, 1981.1/ In your letter, you state that your previous mimeographed letter to the Itomic Safety and Licensing Board (" Licensing Board") of March 4,1981 should now be considered to be your "REAL application" and "no longer a conditional application".

At the same time, however, you state that you "need some sample printed guide-lines which meet NRC regulations" as to petitions for leave to intervene.

Based upon this infonnation, the Staff believes that you intend to file in the near future a petition for leave to intervene which is different from that contained in your mimeographed letter of March 4,1981.

For this reason, the Staff has requested and received pennission from the Licensing Board to defer filing a response to your March 4,1981 letter until such time as you file your actual petition for leave to intervene.y If, in fact, you do not intend to file any further document in the nature of a petition for leave to intervene, please advise this office at once so that we may respond to your previous submission.

l As to your question concerning the appropriate petition to be filed, please be advised that NRC regulations do not specify any particular fonn of M our letter was received by our office on or about March 16, 1981.

Y Inasmuch as it refers to other correspondence dated March 4 and 9, 1981, I presume that your letter was actually prepared on March 13, 1981, and not on February 13, 1981, as indicated.

10 CFR 6 2.714, however, does set forth certain substantive requirements for petitions for leave to intervene (a copy of that regulation is enclosed). Once again, I urge you to comply with the provisions of that regulation. Also, for whatever assistance they may provide, I enclose a copy of the petition and supplement thereto filed by Cathalynn Donelson in this proceeding, dated November 9 and December 6,1980, respec-tively, as well as the Staff's response dated December 1,1980.
