We would like to reference the Geology and Geotecnnical Engineering Report for Trenches 14 and 14A of the Sheffielo Low-Level Waste Disposal Facility in a report which the staff is preparing. However, according to cur records, portions of this document and others associated with the review and approval of Trenches 14 and 14A should be treated as pro::rietary and withheld feca public disclosure. Tha purpose of this letter is to clarify this issue.
The Geology and Geotechnical Engineering Report was one of four documents in your November 4,1975 apolication. The four were:
Cocument 1 - NECO's Radiological Controls and Safety for Burial Sites Manual Cocument 2 - NECO's Site Operations Manual for Low-Level Rad-Waste Dis):osal at Sheffield, Illinois Cocument 3 - Radiological Assessment Evaluation for Trenches la and 14A Cocument 4 - Section 1.5 Geology and Geotechnical Engineering for Trenches 14 and 14A; Section Response to NRC Questions and evaluation of trench bottom elevations.
Supplemental information was provided by a letter dated November 13,1976 to Bernard Singer. Withholding of material in Documents 1, 2, and 4, and the November 18 submission was addressed in U. S. Ecology, Inc., (formerly NECO) letters to Mr. Bernard Sin.ger, then Chief of _the Radiocctive Materials Licensing Branch, dated December 29,1976 (with accompanying affidavit)~andTei:embir 30, 1976, and ~in NRC's letter dated December 29, 1976. Copies of these three letters are enclosed for your convenience.
We would infer, given the current status of the Sheffield site and the events of the last four years, that U. S. Ecology, Inc., would have no reason to consider the Engineering Report on Trenches 14 and 14A as proprietary. In fact we -irfer that only Procedure G-004, " Radiological Control Training Records and Lesson 810 3 2 605Q-n C-.
Vincent de Poix Plans" from Document I and Section 4.0, "Sheffield Site Security" from Document 2 should be withheld. Such withholding would be consistent with the agreement reached on the expansion / renewal application as reflected in your letter to Michael J. Bell dated September 7,1977.

If you have justification of why any other material should be kept in proprietary status in accordance with applicable regulations please advise us within thirty days of the date of this letter. If you do believe proprietary treatment is still justi-fled please provide reasons pursuant to I 2.790.
If no such notification is given, the Geology and Geotechnical Engineering Report and the other documents in the Submissions in support of Trenches 14 and 14A, with the above stated exceptions, will no longer be considered proprietary.
