Appendix A NOTICE OF VIOLATION Dairyland Power Cooperative Docket No.

50-409 As a result of the inspection conducted on December 8-11, 1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

Technical Specification 2.11.2.5 requires that radioactive gaseons releases be made through the plant stack and be monitored.

Contrary to the above, an unmonitored release path existed through the oil storage room ventilation exhaust. An unmonitored release actually occurred by this path on June 29, 1980. Release calculations indicate that neither the quantity nor concentrations exceeded regulatory limits.

This is a Severity Level 5 violation (Supplement IV).

10 CFR 20.201(b) requires that surveys be made as necessary to comply with of 10 CFR 20.

Contrary to the above, surveys were not made outside of the radwaste building to determine compliance with 10 CFR 20.203(b).

Surveys made by the inspectors, -and confirmed by the licensee, found radiation levels between five and ten mR/hr at 18 inches from the door of the radwaste building. The area was not posted as a radiation area.

This is a Severity Level 5 violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within twenty-five days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
