'5PENDIX A NJ._ JE OF VIOLATION David Witherspoon, Inc.

License No. SNM-952 Based on the NRC inspection May 23 and August 6,1980, certain of your activities were apparently not conducted in full compliance with hTC requirements as indicated below. These items have been categorized as described in correspondence to you dated December 31, 1974.

A.

As required in part by Condition 9 of your license, the authorized place of use is the licensee's address stated in Item 2 of the license. Item 2 gives the licensee's address as 901 Maryville Pike, Knoxville, Tennessee.

Contrary to the above, the licensed special nuclear material was possessed by you until about the time of this inspection at 1630 Maryville Pike, Knoxville, Tennessee.

This is an infraction.

B.

As required in part by Condition 10 of your license, the licensee shall obtain a certificate from the Babcock and Wilcox Company specifying the maximum quantity of U-235 in each batch of contaminated steel received.

Contrary to the above, a certificate was not available for two shipments received by David Witherspoon, Inc., from Babcock and Wilcox Company on June 19,1968 and June 12, 1969.

This is a deficiency.

C.

As required in part by 10 CFR 19.11(a) and (b) current copies of Part 19

-Part 20, license conditions, documents incorporated into the license, license amendments and operating procedures be posted, or that a notice describing these documents and where they may be examined, be posted. 10 CFR 19.11(c) requires that a Form NRC 3, " Notice to Employees" be posted.

Contrary to this requirement, on the day _of the inspection, neither the documents nor the notices were posted.

This is a deficiency.

D.

As required in part by 10 CFR 20.203(c), areas in which the licensed material is used or stored shall le conspicuously posted with a sign or signs bearing the radiation caution symb31 and the words: " CAUTION RADIOACTIVE MATERIAL".

Contrary to the above, the arsa where licensed material was stored was not posted with a " Caution Radioacte e Material" sign.

This is a deficiency.

E.

As required in part by 10 CFR 20.207(a), licensed material stored in an unrestricted area shall be secured from unauthorized removal from the place of storage.

Contrary to the above, the licensed materiai possessed by you at 901 Mary-ville Pike was not secured from ui authorized ren > val from the place of storage.

This is an infraction.

F.

As required in part by 10 CFR 70.52'_h)(1), each licensee shall keep records showing the receipt of special nuclear r.aierial.

Contrary to the above, the licensee did not keep a record of receipt of 1760 grams of U-235 receit ed June 19, 1968 and June 12, 1969.

This is a deficiency.

G.

As required in part by 10 CFR 70.58(j), physical inventory procedures shall be established and followed so that special nuclear material balance and their measurement uncertainties can be determined on the basis of measure-ments in compliance with the material balance and inventory requirements and criteria specified in 70.51.

Contrary to the above, you have not established physical inventory procedures and a physical inventory of special nuclear material has not been made since your receipt of 1760 grams of U-235 in 1976.

This is an infraction.
