IMPOSITION OF A CIVIL PENALTY - $4,000 By EN-80-23, dated June 17, 1980, the Commission was notified of the intent of IE to issue a Notice of Proposed Imposition of a Civil Penalty in the amount of l

Four Thousand Dollars to Georgia Power Company. The proposed penalty was based on an alleged item of noncompliance relating to radiation levels in a truck cab which exceeded the regulatory limit.

The licensee responded to the Notice in a i

letter dated July 14, 1980. After consideration of the licensee's response, the IE Staff concluded that the item of noncompliance did occur and no adequate reasons were given by the licensee for mitigation or remission of the proposed penalty. Accordingly, an Order imposing a Civil Penalty in the amount of Four Thousand Dollars has been issued today.

The licensee and the State of Georgia will be notified by telephone.

Since this matter was the subject of an NRC news release on June 19, 1980, no additional release is planned. The Office of Public Affairs will respond to inquiries as received.

Under the terms of the Order, the licensee may, within twenty-five days of the date of the Order, pay the civil penalty or request a hearing.
