ARTICLE I - Description of Work This Basic Ordering' Agreement (80A) as defined in Federal Procurement Regulation 1-3.410-3, provides the terms and conditions under which the contractor is required 'to provide the services identified under Article II.

This agreement is primarily used as a means of expediting procurements and is neither intended to restrict competition 1nor imply that the government will place future orders for these services.

During the performance period of this agreement (approximately one year with an option for one additional year), task orders representing various projects within the scope of the work statement will be issued periodically.

The type of contract employed for each Task Order will be subject to negotiation.

Such services shall be as generally described in the following Statement of Work:

STATEMENT OF WORK A.

Background

Uranium recovery operations such as milling, heap leaching, or in situ leaching (solution mining) of uranium are may produce significant impacts on water quality. Various chemicals added to the ore or compounds solubilized during the recovery process may cause a degradation in water quality. Most of the radionuclides in the original ore other than uranium are not removed in the recovery process and processing of the ore may increase the potential for these radionuclides (principally Th-230, Ra-226, Pb-210, Po-210) to enter water sources.

With these impacts in mind, performance objective three of the staff's Branch Position on Uranium Mill Tailings Management (Exhibit A) requires the design of the isolation area such that seepage of toxic materials into the groundwater flow sytems would be eliminated or reduced to the maximum extent reasonably achievable.

Consumption of water is an impact on water resources since water used in uranium recovery operations is unavailable for other uses.- Also, a depression in the groundwater table caused by withdrawing groundwater could impact other groundwater users in the area.

Evaluation of probable or potential environmental impacts is an integral part of the licensing process for uranium recovery facilities.

In accordance with Nuclear Regulatory Commission (NRC) regulations,

Page 4 of 22 environmental appraisals or environmental impact statements are required to support licensing decisions on new license applications, license renewals, proposed major modifications, and in some cases, decommissioning plans for uranium recovery operations. The NRC's Office of Nuclear Material Safety and Safeguards (NMSS) requires technical assistance in the environmental assessment of surface and groundwater impacts of applicant proposals for uranium recovery operations. These surface and groundwater impacts assessments together with other assessments (such as the socio-economic, long-term stability, and radiological assessments), will be used by NMSS in detennining the acceptability of an applicant's proposal.

They will also be used in the associated environmental appraisal reports or environmental impact statements (draft and final statements).

B.

Work Required The contractor shall prepare environmental assessments of surface and groundwater impacts from uranium recovery operations. Of major import-ance will be assessments of impacts due to seepage, leaching solutions containing radionuclides and other contaminants. A separate, independent review will be required for each project (Task Order).

The NRC anticipates receipt of proposed projects for uranium recovery operations during Fiscal Years 1980, 1981, and 1982. At this time it is not possible to identify these projects; however, the projected workload is five to fifteen new projects per year.

The contractor shall supply the necessary facilities, material, se.sices, and personnel to accomplish the following tasks:

Task 1 Upon award of the Task Order for a project, the NRC project officer shall supply the contractor with the applicant's submittals as supplied to the NRC by the applicant. These submittals may include applications, environmental reports, and supplemental information.

The contractor shall review the applicant's submittals to determine if the applicant has provided sufficient information for the contractor to perform the impacts assessment required under Task 2.

The contractor shall identify any requirements for additional information. Any request for additional information shall be made of the applicant by the NRC project officer with a written list of required additional information for each project and the project officer shall transmit the list to the applicant.

Should the need for second-round questions arise, i.e., the contractor makes a second request for additional information, the same procedure shall be followed.

Generally, these events will take place as follows: the contractor will make the initial request for additional information within thirty (30) days of receipt of the applicant's submittals.from the project officer. The project officer shall supply the applicant's response to the contractor within forty-five (45) days of receipt of the request for additional information. The contractor shall make a second request for additional information, if necessary, within thirty (30) days of receipt of the applicant's response to the initial request from the project officer. The project officer shall supply the contractor with the applicant's response to the second request for additional information within forty-five (45) days of receipt of the contractor's request for same. HOWEVER, LONGER OR S!!0RTER TIME-FRAMES MAY BE NECESSARY FOR INDIVIDUAL PROJECTS AND SHALL BE SPECIFIED IN EACH i

Task 2 The contractor shall prepare environmental, hydrogeologic, and engineering assessments of surface and groundwater impacts from uranium recovery operations in conformance with performance objectives as specified in tho Waste Management Technical Branch position attached hereto as Exhibit A.

In preparing the assessments, the contractor may l

perform work including, but not limited to the following items:

1.

Become familiar with the site by visiting the site and reviewing the information on the local and regional groundwater and surfacing water flow systems, hydrostratigraphy, geology, hydrology, water quality data, water users, aquatic biology, and any other parameters which bear an analysis of the surface and groundwater impacts in the study area.

2.

Evaluate the validity'of data collected by the applicant.

Such data may include, but not be limited to: groundwater flow patterns and velocity; groundwater, seepage, and surface water quality; drill hole and geophysical borehole logs; hydrostratigraphic units; piezometer readings; laboratory

'and in situ permeability data; distribution and dispersion coefficients.

3.

-Review the applicant's estimates of and basis for determining:

the quantity of seepage; the present and eventual extent of contamination; whether or not seepage or leachate has or will affect human, livestock, or wildlife water supplies and what the resultant impacts are or are expected to be.

Prepare an independent assessment of these items. Note: socioeconomic impacts are not part of this task.

Evaluate the licensee's present and future groundwater monitoring program for the placement of monitoring wells, zones monitored, sample analysis, and the ability of the program to give reliable, early, and continued indication of potential seepage problems.

5.

Evaluate impacts of water withdrawal from surface or groundwater.

These impacts include the creation and spread of a cone of depression in a groundwater table, reduced well head and flows, and reduced surface water flows.

Note: Socioeconomic impacts are not part of this task.

6.

Evaluate the reasonableness of the facility water balance.

7.

Recommend mitigating actions if needed.

8.

Evaluate the adequacy or effectiveness of the groundwater restoration program for all in situ leach mining applications and if direc.ted by the ' project officer for those tailings sites where seepage has necessitated groundwater restoration.-

9.

Perform computer modeling of seepage and containment migration (using available existing models).

10.

Evaluate the adequacy of the design of temporary diversion l

ditches and/or drainage channels.

11.

Perform an accident analysis of failure of a tailings impoundment or piping system.

(Guidance is provided in NRC Regulatory Guide 3.11). This shall include estimates of the extent of the spread of contamination.

12.

Evaluate the effectiveness of seepage control measures of artificial liners.

Note:

Items 9,10,11, and 12, above will be specified as options in the Task Orders. This work will be performed by the contractor only upon receipt of written authorization from the contracting Officer.

Task 3 The contractor shall respond to public comments or agency (state or federal) comments on the contractor's evaluations if requested by the contracting officer. The contractor shall also defend the evaluations in public hearings (i.e.. Public Scoping meetings, Agreement State hearings, and/or Adjudicatory hearings).

Note: The contractor shall not perform any work under this task without the specific written authorization of the contracting officer This task will be included as an option under the Task Order and the work will only be authorized by the contracting officer.

Page 7 of 22 Task 4 The contractor 'shall maineain a complete file on the documentation for all work performed under Tarks 1 through 5.

This file will contain one copy of each document referenced and/or developed in connection with the tasks. This will include, but is not limited to, original graphics, detailed calculatiocs, meetings minutes, trip reports, USGS topographic maps, technical journals, published studies, etc. The' contractor shall deliver this entire file of documentation to the ic4SS project gfficer at the completion of the specific project.

Task 5 On some projects it may be necessary to collect field data and perform laboratory analysis related to surface and groundwater impacts.

This work may include, but not be limited to: drilling, soil sampling surface and groundwater sampling, chemical and radionucifde analysis, geophysical logging, and laboratory and in situ permeabilitiy testing.

As a minimum, the contractor shall be able to measure the following constituents in water:

Reporting Requirements Separate reports are required for each project as follows:

Task 1 Report The contractor shall submit to the NMSS project officer a letter documenting the review of the applicant's submittal (s) and any deficiencies noted.

2.

Task 2 Report The contractor shall' report the assessment of surface and groundwater impacts performed under Task 2 in a technical evaluation report in which the major technical areas reviewed are identified, the nature and extent of the review is characterized and conclusions are stated.

The assessment shall be presented in a format compatible with NRC's recent' environmental statements.
