Gentlemen:

This is in response to Mr. Abel's letter of August 12, 1980, concerning

an item of noncompliance identified at the Byron Station and brought to

your attention by our letter dated July 10, 1980. We have reviewed your

response and our position on this matter remains unchanged.

We acknowledge that our finding of a " common header" was a mischaracteri-

zation; however, our finding that a nonconforming condition exists remains

,

unchanged.

Cooling system lines essential to operation of the redundant

j

cmergency diesel generators, do not meet the single (common mode) failure

criteria.

Lines serving both generators are located, in part, in a

common room housing one of the emergency diesel generators such that a

single postulated accident could lead to failure of both cooling lines

and thus failure or degradation of both generators.

The following clarification is provided concerning the statement in the

last paragraph of your response relative to respective NRC responsibilities.

The inspection and administrative practices of the Nuclear Regulatory

Commission routinely include verification of the licensee's adherence

to design commitments, which in turn relate to the design criteria.

Failure to meet these commitments does constitute an item of noncompliance.

To reiterate, your response must include:

(1) The corrective steps which

have been taken by you and the results achieved, (2) the corrective steps

which will be taken to avoid further noncompliance, and (3) the date when

full compliance will be achieved. Section 2.201 of 10 CFR Part 2 requires

that you respond within thirty. days of your receipt of this letter.
