Dear David:
This is with regard to the December 17, 1976 letter of the Nuclear Regulatory Commission Staff, requesting Dow's response to six specific questions.
We are preparirg our response, and will have it completed so that it can be in the Staff's hands by the December 30,1976 date.
How-ever, the questions are similar to some asked of Mr. Temple during his cross-examination.
Objections were made to some of those questions, and some were sustained.
The questions also inquire into areas which might well have been the subject of the affidavits to which the Board referred at the December 14 pre-hearing conference, but which it has now decided need not be submitted.
Finally, the questions seek evidence which will be the subject of Mr. Temple's continued cross-examination in January.
Accordingly, we consider it appro-priate that Consumers be given an opportunity to object before we respond.
This is to advise that we will furnish the responses to the NRC Staff on or before December 30, 1976 unless we receive contrary instructions before that time.
I'll be away next week, and ask that any response occurring after Christmas be sent to Milton Wessel'at his White Plains address.
