Dear Mr. McKinley:

We have reviewed the final revisions to the Kentucky regulations, Title 902 of the Kentucky Administrative Regulations Section 100, received by our office on November 14, 2019. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2001-1, 2008-1, 2011-1, 2012-1, 2015-1, 2015-2, 2015-4, and 2018-1, as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Jerry Hensley on December 5, 2019.

As a result of our review, we have 35 comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Kentucky, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Kentucky regulations, as indicated. (3)(c)3. This is less restrictive than the requirement in 10 CFR 31.5(c)(4). 10 CFR 31.5(c)(4) states that these records should be maintained for three years.

KY needs to change the retention time to three years after the next required test for each of the tests described in 100:050 Section 3.(3)(c)4. in order to meet the Compatibility Category C designation assigned to 10 CFR 31.5(c)(4).

In general, KYs regulation is more restrictive than 10 CFR 19.13 which is allowable for regulations designated as Compatibility Category C.

However, KY needs to change 100:165 Section 3(4) to read A licensee or registrant shall make dose information available to workers as

TEDE or 1 mSv (100 mrem) to any individual organ or tissue; or (2) The individual requests his or her annual dose report.

20 902 KAR 20.1003 2008-1 A Definition: total effective dose 100:010 equivalent (TEDE)

Section 1 (312) KY needs to change 100:010(312) to read means the sum of the effective dose equivalent (for external exposures)

KY needs to change 100:040 Section 14.(2)(b) so that those records are maintained until a license is terminated in order to meet the Compatibility Category C designation assigned to 10 CFR 40.61(a)(2).
