Enclosed are UCS's Proposed Findings of Fact and Conclusions of Law on UCS Contentions Nos. 13 and 14 and Board Questions 6 and 2.

UCS hereby adopts the Proposed Findings of the Commonwealth of Pennsylvania on burden of proof and related issues.

(Common-wealth of Pennsylvania's Proposed Findings of Fact and Conclu-sions of Law on Plant Design and Modification Issues (First Set),

paragraphs 1-13).

In addition, UCS'r. Proposed Findings contains what is essentially a request that the Board reconsider its ruling against taking official notice of the diesel generator failure estimates in WASH-3400.

This appears at paragraphs 418-421.

We ask the Board to treat this as a request for reconsideration.
