The C:mmission believes the uncertainties inheren; in reif ance on the geological se :ing alene are too great :: de reconciled in an adjudicatory Or: cess.

The Commission further believes the staff presumptions that a respcsitory woul consis cf two. major engineered barriers (waste packages and uncergrounc facilit.ies) in accition to the natural barrier provided by the geological se :'ng are correct anc reasonable.

Having reached these conclusions, :ne Commission considers next whether or not and :: wna: level of cetails the perfen:ance :riteria f:r a geological repository shoulc be pres:ribed.

In this regard, the Commission :ensiders the fc110 wing three alternatives *:

1.

Prescribe a single overL11 performance standard that must be met.

The Stancard in this case would be One EPA stancarc; 2.

Drescribe minimum performance standards for ea:n of the major elements, in addition to requiring the overall system to meet the EPA stancards; and 9

Notwithstancing the concern over its practicali y f r. tne regulatory framework, the Commission cannot at this time elimina:e it fecm further consideration.

The Commission is, therefore, specifically t

j requesting the general public, par-icularly : nose from the :eennical l

Ocmmunities, to ec= ment on this point.

In relation to the first and the third alternatives :na; are Oriefly discussed above, Alternative 2 appears to offer a reasonabi.e anc ;ractical l

In acdition to retaining the single overall performance stancard in Alternative 1 as the final performance objective, this ac;,r0ach estatiishes ne minimum :erf rmance :: jet.ives for ea:n of the
