Gentlemen:
The new NRC enforcement policy, as described in the Federal Register Notice (45 FR 66754) dated October 7,1980, includes a requirement that responses to Notices of Violation normally be submitted under oath or affimation. The authority for this requirement is Section 182 of the Atomic Energy Act of 1954, as amended. We have received many different forms of statements of cath or affimation and we have received a number of questions regarding the form that should be used for these statements. The statement of oath or affirmation is intended to be a certification by the licensee representative that the response statements are true and correct and is not a simple witnessing of the representa-tive's signature.
Our other Regions have experienced similar problems and have received similar inquiries.
In the interest of providing some guidance in this area we have reviewed the oath / affirmation statements that we have received and find that a statement such as that shown in the attachment to this letter would be accept-able and we encourage you to use it or an equivalent statement.
It is noted that the statement should be notarized as shown in the attachment.
