The new NRC enforcement policy, as described in the Federal Register Notica (45 FR 66754) dated October 7,1980, includes a requirement that responses to Notices of Violation normally be submitted under oath or affirmation.
The authority for this requirement is Section 182 of the Atomic Energy Act of 1954, as amended.
We have received many different forms of statements of oath or affirmation and we have received a number of questions regarcing the form that should be used for these statements.
The statement of oath or affirmation is intended to be a certification by the licensee representative that the response statements are true and correct and is not a simple witnessing of the representa-l tive's signature.
Our other Regions have experienced simi.lar problems and have receited similar inquiries.
In the interest of providing some guidance in this area we have reviewed the oath / affirmation statements that we have received and find that a statement such as that shown in the attachment to this letter would be acceptable and we encourage you to use it or an equivalent statement.
It is noted that the statement should be notarized as shown in the attachment.
