w Gentlemen:
The new NRC enforcement policy, as described in the Federal Register Notice (45 FR 66754) dated October 7,1980, includes a requirement that responses to Notices of Violation normally be submitted under oath or affirmation.
The l
authority for this requirement is Section 182 of the Atomic Energy Act of 1954, I
as amended.
We have received many different forms of statements of oath or l
affirmation and we have received a number of questions regarding the fom that should be used for these statements. The statement of oath or affirmation is inter.ded to be a certification by the licensee representative that the response statements are true and correct and is not a simple witnessing of the representa-tive's signature.
Our other Regions have experienced similar problems and have received similar inquiries.
In the interest of providing some guidance in t#. area we have reviewed the oath /affimation statements that we h&ve rece1C and find that a statement such as that shown in the attachment to tnis letter would be acceptable and we encourage you to use it or an equivalent statement.
It is noted that the statement should be notarized as shown in the attachment.
