Dear Mr. Keppler:

Your letter (Reference 1) informed us of an apparent non-compliance of our activities with regard to 10 CFR 50.54 (u).

This letter con-stitutes the written statement with regard to your " Notice of Violation" contained in Appendix A to Reference 1.

Enforcement Item As a result of an attempted Emergency Plan Revieu conducted on March 2, 1981, and in accordance uith the interim Enforcement Policy 45 FR 66754 (October 7, lu80), the following violation uas identified:

10 CFR 50. 5 4 (u ) states:

"Within 60 days after the effective date of this amendment (November 3, 1980) each nuclear pouer reactor licensee shall submit to the NRC plans for coping uith emergencies that meet standards in 50.47(b) and the requirements of Appendix E of this part."

Contrary to the above, emergency plans due January 2, 1981, have not been submitted.

DPC Respo.1se Our letter (Reference 2) forwarded ten (10) copies of the upgraded radiological emergency response plan for LACBWR to the NRC Office of Nuclear Reactor Regulation.

S. Nuclear Regulatory Commission April 6, 1981 Directorate of Regulatory Operations page 2 that the reason for the delay was attributed to a refueling outage and ASLB hearings on site liquifaction.

The recent termination of the Health and Safety Supervisor was also a factor in the delay.

It should be noted that Revision 1 of NUREG-0654/ FEMA-REP-1 was forwarded to us on December 9, 1980.

Our letter (Reference 1) also discussed advisories which were sent to the NRC regarding our progress and further expressed our opinion that the current NRC-approved emergency plan and implementing pro-cedules for LACBWR provide appropriate protective measures in the event of a radiological emergency.

This plan was used for a joint State, local, county and plant drill on May 11, 1979.

We have estimated that full implementation of the upgraded plan,.( / [/.9##

and procedures cannot be accomplished prior to June 1,198L.
