SUBJECT:
TMI-l RESTART ASLB HEARING In your note to me, of March 27, 1981, you requested that I respond to two questions in writing.
To fully answer these questions would require the review of the entire hearing transcript (well over 15,000 pages),
something that I have not done and have no plans of doing. My answers, therefore, are based on the best of my knowledge and belief.
Q. 1:
Is there any information you wish to present to the Licensing Board which has not already been presented to Congressional committees or to the Commissioners directly? If so, please state what that information is.

I assume that by "been presented," you mean been presented by me.
Q. 2:
, Are there any material facts in your possession bearing directly upon the TMI-l restart which you have not already brought to the attention of the Board or which have not already been brought to the attention of the Board through Staff or other testimony.
If so, state what those facts are and specify their significance to the restart of TMI-1.
A.
I cannot answer your question definitively because I do not know your definition of " bearing directly upon the TMI-1 restart," nor am I familiar with all testimony given to the Board by Staff and others.
It may be helpful to note that I have not performed a review of the TMI-l systems design, and my concerns submitted to the Board are generic with, what I considered, direct applicability to the TMI-1 restart. This is not to imply that other generic concerns that I have raised elsewhere in the past may not be directly applicable to the TMI-l restart. However, I strongly recommend that the Board requests and receives testimony by the Staff on the overcooling transients that may'be caused by failures of the control systems on the seccndary side, and their implications to the structural integrity of the reactor vessel of TMI-1.

APR 0 71931 that in such testimony there should be a discussion of the applicability and significance of the recent discovery of a discrepancy in the estimated vs. the measured values of the neutron fluence that the reactor vessel has been exposed to, in the case of the Maine Yankee reactor. The results of dosimetry measurements indicate the actual fluence to be some 2.3 times higher than those estimated in the FSAR.
I wish to take this opportunity to reiterate that the thrust of my communications to you and the Board was contained in Differing Profes-sional Opinion Board Notification (BN 80-15),2 which was intended to challenge the Staff's position that " safety systems will mitigate control systems' failures at any power."
It was also intended to bring forth the safety implications of control systems in the specific example of overcooling transients and their direct and substantial threat to the structural integrity of the reactor vessel. See documents No.12-16 listed on last page of BN 80-15.1 On this and related matters of systems interactions, the concerns of Dr. Jordan are well placed.
I hope that this has been responsive to your request.
Please make a copy of this memorandum available to the Board.
I will appreciate receiving a written notification of the date that this takes place.
