Enclosed herewith is " Applicants' Response to Order Setting Final Prehearing Conference".
The response incorporates our reply'to the Staff's request to establish a final cutoff on Mr. Bursey's filings to seek relief from sanctions for failure to fulfill discovery obligations.
Also, on page 8, I have sug-gested that the matter of the untimely petition to intervene by Fairfield United Action, Inc., be taken up at the prehearing conference. 'The Board may wish to issue an Order directing Mr. Ruoff or another authorized representative to attend the April 7th prehearing conference and advising him to be prepared to argue on all aspects of the petition, in-ciuding its lateness, good cause for late. filing, if any, and all matters pertaining to contentions.
