'eram- Discharge Systems" dated January: 9, .1981, be revised as

described below.

Section III.1 of the " Confirmatory Orders" dated October 2, 1981, states that:

"Py December 1, 1980, the licensee shall:

a) Install and make operable a system to continuously monitor water levels in all scram discharge vol umes (SDV) .

b) The installed system shall provide for level indication, with an associated alarm in the control room, for each SDV. This equipment shall provide sufficient information to the reactor operator such that if water accumulates in either SDV the decision about actions to be taken can be made in a timely fashion from the control room."

Section IV of _the " Order for Modification of License"

. dated January . 9,1981, states in - part that:

"1) An automatic system shall be operable to initiate control rod insertion on low pressure in the control air header...

2) - After April 9, _1981, the Automatic Dump System...shall be opernble in all modes other than shutdown and refueling or the unit shal]

be placed in a cold shutdown condition within 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> unless system operability is restored."

Licensee hereby requests that L5e requirements as stated above for the SDV Jevel monitoring system and for the automatic air dump system be deleted from Operating Licenses DPR 44 and DPR-56 for Peach Bottom Atomic Power Station Unit !!os . 2 and 1 af ter permanent modifications providing adequate ' idraulic coupling between the SDV and the scram discharge .n str um en t volume (IV } have been completed on each unit.

This request is based on the Nuclear Regulatory staff position that these requirements are interim measures for BWR units that do not have an adequate SDV to IV hydraulic coupling and are only required until permanent modifications can be implemented to correct the problem.

The staff's position on the SDV level monitoring nystem in stated in Section 1.1.1.1 of the Generic Safety Evaluation Report (SER) concerning BWR Scram Discharge Systems dated Dacember 1, 1980 It states in part that "until changes are im pl em ent ed to improv e 1.he design of the hydraulic coupling between the SDV headers and TV, ( tection of any significant accumulation of water in the SDV is provided by directly monitoring the SDV".

Supplement 1 to the SER dated January 12, 1981, cicarl y identifies ' the automatic air dump system as an _ interim measure by stating " . . .this system ( i .e . , automatic air 11mnp system) is only required in the interim until permanent modifications are in place to improve the hydraulic coupling between the SDV and the l ev el instr umentation" .

The permanent modifications , described in a letter from 4

9 L. Daltroff to D. G. Eisenhut dated December 16, 1990, will extend the existing SDV's to connect directly into the TV and wil l provide adequate hydraulic coupling between the SDV and the (V. This will meet the B'In Cwner's Group proposed designed ,

criteria as stated in the Dacember 1, 1980 SF.R. The new pipina, util be equal in cross sectional area to that used for the existing SDV's and thus will ensure proper drainage. There will ha no dependence on the vent and drain system for the proper i-detection of water, and additional discharge volume will be

, provided as added margin for scram capability.

The Unit 2 modifications are to be completed during tha next refueling outage which is presently scheduled for the Son,inninglof 1982. The Unit 3 modifications are scheduled fo r the 1981 Spring refueling outage contingent upon the timely xroceipt of equipment : and materials required for the modifications.

Pursuant to 13 CFR Section 170.22, Philadelphia

. Electric Company, for fee purposes, proposes that the Appliention Lfor Arendment be considered a Class III Amendment for Unit P and a Class T Amendment for. Unit 3, since the proposed changes arn

!"en ed not to involve a significant hazards consideration.

The Plant Operation Review Committee and the Operation and Safety Review Committee have reviewed these proposed changes ,

and have co ncl ud ed that they do not involve an unrev iewort m ro *. y question or a significant hazards consideration, and will not endanger the health and safety of the public.
