PROPOSCD IMPOSITI0ft OF A CIVIL PENALTY - $40,000 This is to inform the Commission that a Notice of Proposed Imposition of a Civil Penalty in the amount of Forty Thousand Dollars will be issued on February 18, 1981 to Florida Power and Light Company.

This action is based on Unit 3 operating at full power without an operator present at the controls in violation of 10 CFR 50.54.

The civil penalty is assessed against the licensee for a system designed to prevent or mitigate a serious safety event not being able to perform its intended function under conditions requiring operator actions at the Control Console. A news release has been prepared and will be issued about the time the Licensee receives the Notice.

The State of Florida will be notified.

It should be noted that the licensee has not been specifically informed of the enforcement action.
