Dear Senator Rodriguez:

December 11, 2019 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter of November 18, 2019, addressed to Siva Lingam of the NRC's Office of Nuclear Reactor Regulation regarding the application by El Paso Electric Company for transfer of its Palo Verde Nuclear Generating Station and Independent Spent Fuel Storage Installation licenses. Your letter expresses support for the hearing request submitted by Public Citizen.

Your letter was forwarded to the NRC's Office of the Secretary. The Office of the Secretary is comprised of "adjudicatory employees" who advise. the Commission on various matters, including those such as the Palo Verde license transfer proceeding. Because, as you note in your letter, the NRG has received a request for hearing on the license transfer application and your letter relates to subjects that may be raised during any resultant adjudication, it would be inappropriate for the NRC to comment on the matter at this time.

A copy of your letter and this acknowledgment will be served on the parties in the Palo Verde proceeding.

I am the state Senator representing not only El Paso in the Texa Senate, but also four other West Texas Counties - Hudspeth, Culberson, Jeff Davis and Presidio. My d strict, Texas Senate District 29, is home to more than 800,000 people and hundreds of thousands of El Pas Electric (EPE) Company business and residential customers and ratepayers. IIF US Holdings 2 seeks t purchase EPE, which is of compelling public interest for Texas Senate District 29.

EPE is a partial owner of the Palo Verde nuclear power station. As part of a proposed purchase, EPE seeks approval from the Nuclear Regulatory Commission (NR ) for "Indirect Transfer of Control of Licenses" for Palo Verde to IIF US Holdings 2.

I understand that you have received a request for public hearin from Public Citizen, a consumer advocacy group that has members in El Paso and Arizona, whe e Palo Verde is sited. Public Citizen has raised credible issues of fact regarding who owns and controls US Holdings 2, which it seeks to resolve through a hearing.

EPE is too important to the constituents of Texas Senate Distri not within my district, for such a substantive question to be in Public Citizen request, and ask that you grant a public hearing 29, and to those in the region who are ubt. Therefore, I am in full support of the n the matter.
