e We have received a copy of your application dated August 19, 1980, which was filed With the Office of Nuclear Reactor Regulation (ONRR) for review. This application was filed as Proposed Change No. 89 and involved Technical Specification changes related to Reload 7 and the definition of operable for your Vermont Yankee Nuclear Plant. A Class III fee of $4,003 was remitted with your application for the Reload 7 changes.
Based on information provided by the ONRR staff as a result of a preliminary review of your application, it has been determined that the Class III fee paid for the Reload 7 changes is appropriate. However, the change related to operable is a separate review item unrelated to the reload changes and as such is subject to a separate fee assessment.
For this particular facility, the operable change has been determined to be in the Class II fee category which requires a fee of $1,200, We recognize that the operable change was requested by the NRR staff's letter dated April 10, 1980; however, they were not requested for the convenience of the Comission, but rather to assure safety system availability and performance. On this basis, some licensees have paid fees for the operable applications and others are being requested to pay fees for them.
It is requested that your Company remit an additional sum of $1,200 to this office to cover the operable change.
If the final review of your application by the ONRR staff reflects that the fees assessed for your August 19 application are incorrect, an adjustment will be made.
