Dear Mr. Hoffman:

The Comission has issued the enclosed Supplement No. 3 to the April 4,1979 Fire Protection Safety Evaluation (FPSE) for the Big Rock Point Plar.t.

Supplement No. I was issued on March 11, 1980. Supplement No. 2 was issued with License Amendment No. 32 dated March 27, 1950.

In L:.: tion 3 of the FPSE, certain items were identified as inconplete and requiring certain information from Consumers Power Conpany and evaluation by the NRC staff.

We have conpleted our review of the remaining incomplete item (Item 3.2.1, Fuel Pool Cooling) as provided in your submittals dated h: ember 28, 1979, and June 20, 1980. We have also completed our review of your submittal dated August 24, 1979, which requested a deferral in the implementation of the alternate safe shutdown system until completion of the Systematic Evaluation Program (SEP) review.

The results of our review are described in Enclosure 1.

We find that all the inconplete items in the FPSE except the design of the alternative safe shutdown capability have been acceptably resolved subject to the in: 1ementa-tion of the remaining items shown on Table 3.1 of the enclosure. We also find that your request for a deferral of the implementation of the alternate safe shutdown system until after conpletion of the SEP is not acceptable.

The conpletion date for alternate safe shutdown capability shall be governed by the requirements of Section 50.48 to 10 CFR 50 when it becomes effective.

As you are aware, on May 23, 1980, the Commission published a proposed Appendix R to 10 CFR Part 50, concerning fire protection in nuclear power plants. The proposed rule sets forth the mininum acceptable fire protection requirements necessary to resolve contested areas regarding fire protection for nuclear power plants operating before January 1,1979. Enclosure 2 presents our position on the alternate safe shutdown systen for the Big Rock Point Plant. This position specifies the areas for which modifications would have to be provided at your facility to resolve the alternate safe shutdown capability in a manner that would meet the requirements of the proposed Appendix R.
