Dear Mr. Fuller:

We have received your letter of October 20,1980(P-CJ368)whereinyou withdrew your previous request for a hearing related to our order dated August 29,1980.

As you know, the Order of August 29, 1980 was revised in its entirety by the revised order dated September 19, 1980, which provided revised oppor-tunity for hearing. You have not requested a hearing under the September 19, 1980 order, and we understand that your request to cancel tne hearing, specifically waives your opportunity to request a hearing under the September 19,1980 order (in the absence of any request by any other person).

Thus, as matters stand, you have withdrawn a request for hearing under the earlier order which has been superseded, and you have not requested a hearing under the September 19, 1980 revised orders. We have received no other request for hearing involving the September 19, 1980 order with respect to your facility. Thus, as we see the situation, there are now no pending requests for hearing on the September 19, 1980 order applicable to the Ft. St. Vrain facility.
