Dear Mr. Denton:

Northern Indiana Public Service Company (NIPSCO) has previously^l requested extension of Construction Permit No. CPPR-104.

(See my letters to you dated February 7 and August 31, 1979.)

As heretofore requested, the amendment would extend the exp_iration, date to December 1, 1987.

By letter dated November 3, 1980, 3

counsel for NIPSCO advised the Licensing Board appointed.in the-4; permit extension proceeding that the estimated on-line date for' Ti the Bailly Generating Station, Nuclear-1, is now 1989.

change necessitates further ameadment of NIPSCO's extension request to reflect a different latest date for completion.

This letter will serve to accomplish that amendment.

The previously-identified r scember 1,1987, date was based upon a period of about 83 months to complete construction plus about 15 months for uncertainties.

It was predicated upon the assump-tion that the NRC Staff would complete its review of NIPSCO's pile-driving proposal by October 1, 1979.

That assumption was not fulfilled.

After several times identifying subsequent dates upon which its review would be complete, the Staff has most recently declined to identify any target date and stated only that it "will issue its evaluation as soon as possible.

Failure to complete the Staff review has thus consumed almost 14 of the 15 months included in the requested extension to provide for uncertainties, and the Staff has not estimated how much more time will be required.

NIPSCO plans to resume construction; however, after the pile-driving suspension is resolved, NIPSCO will evaluate the status of QY b'

Denton Page 2 November 26, 1980 its request for extension of the construction permit and determine if construction should proceed prior to approval of the extension.

Of course, without knowing when the pile-driving suspension will be resolved or what the associated circumstances will be, we cannot accurately predict when NIPSCO's own evaluation will be completed and a determination to resume construction could be made.

Moreover once NIPSCO's decision to resume construction is made, additional time will be needed to remobilize contractors, Construction Manager's personnel, Sargent & Lundy's engineering effort and NIPSCO's Nuclear Staff.

This additional time is required because neither NIPSCO nor its contractors could reasonably have been expected to stay in constant readiness to resume construction during the prolonged period of NRC Staff review of pile driving.

A reasonable estimate of the time to complete the evaluation described above and the remobilization process is approximately 6 months.

Thus, after resolution of the pile-driving suspension, a minimum of 6 months will elapse before actual construction can commence.

Our estimate of the time required to complete construction once resumed remains 83 months, as explained in my August 31, 1979 letter.

The above-described circumstances lead us to conclude that a period of 18 months should prudently be included to provide for uncertainties (rather than the 15-month period previously identified).

The uncertainties include those associated with the timing of the NRC review of pile driving and the other matters referred to above and in my letter of August 31, 1979.

Assuming resolution of the pile-driving suspension by January 1, 1981, the requested latest date for completion of construction is December 1, 1989.

Although selection of an 18-month period for uncertainties is admittedly judgmental, it is necessitated at this time both by the described uncertainties and the desire to file this amendment promptly in order to give the maximum notice to the Staff and other parties in the permit extension proceeding.

Accordingly, our February 7, 1979 request, as amended on August 31, 1979, is hereby further amended to reflect that the latest date for completion of construction of aailly N-1 specified in Construc-tion Permit No. CPPR-104 should be extended to December 1, 1989.
