Discussion:

The following documents are forwarded for Commission review of the subject acclication:

(1) staff review ano conclusion that the prcpesed export meets statu-

tory requirements (Aopendix A); (2) Executive Branch views of March 3 and fiay S 1978 recorrending issuance (Appendix B); (S) application of January 25, 1977 (Appendix C); anc (4) ccpy of proposed license (Appendh 0).

This application for an export is the first to Sweden

+

to receive comprehensive analysis in licht of the requirements of the recently enacted iuclear ilonprolifera-tion Act of 1978 (NNPA).

Based upon its reviev; and conclusions and upon tne Executive 3 ranch analysis, the staff has concluded that Sweden currently meets all applicable statt, tory requiraments cf the NNPA fer the issuance of this license.

With respect to futura proposed exports for Sweden, this paper will be referenced, pursuant to the provisions of 10 CFR 110.44, provided tnere have been no material changed circumstances involving Sweden since the previcusly approved license.

It is noted that the material covered by this apolication is intended for conversien in West Germany'(EURATOM) prior to its trans'er to Sweden.

' Discussion:

fact that EURATOM has not, as yet, agreed to negotia-(continued) tions leading to renegotiation of the US-EURATOM Agreement for Cooperation.

Since the material will not r

be irradiated in EURATOM and will not be subject to

=

reprocessing in the Ccmunity, as confirmed by EURATOM in its end-use statement, the staff cor.cludes that the export of this material to the intermediate consignee in EURATOM would meet the equivalent of criterion 5.

In addition the staff believes"that this export to EURATOM would meet all other criteria of the flNpA or their equivalent.

Reccmmendation:

That the proposed license be issued to Transnuclear Incorporated.

Coordination:

OELD has no legal objection.

NMSS wishes to inform the Ccamission that it has not received country-specific information which permits it to make an independent conclusion as to the effectiveness of EURATOM and IAEA material control and accounting safeguards to deter and detect diversions in Sweden and the Federal Republic of Germany (FRG). With regard to physical security, NMSS has reviewed the programs in Sweden and the FRG and found them adequate for the purposes of the export.
