Inspection 50-286/80-09 An inspection conducted on June 24-26, 1980 at the Indian Point Unit 3 Nuclear Power Plant to examine the circumstances surrounding the June 24, 1980 overex-posure of two of your employees revealed that certain of your activities were not ia full compliance with NRC regulatir..s.

T,he inspection findings indicate that sup'rvisory personnel undertook a repair

,ctivity without sufficient consideratio if the radiological hazards. We are particularly concern'ed with your failure use an approved procedure to conduct the repair.

In addition to the above, we are concerned about your failur i to notify the NRC Operations Center of the personnel overexposures descrit ad in Item B of the enclosed Notice of Violation.

Not only is the reportin requirement clearly stated in 10 CFR 50.72, 10 CFR 20.403 contains a re erence to these requirements.

The Commission is presently considering amerfing 10 CFR 50.72 with respect to certain reporting requirements contained it 10 CFR 20.403 and therefore we are not proposing a civil penalty for this ite a of noncompliance.

i We do, however, expect complete compliance with all reporti g requirements of this regulation.

You should assure that your notification irocedures address fully all such requirements.

As stated to you in our letter dated June 27, 1980, we unders and that immediate corrective actions which you have instituted to prev nt additional events of the type described in the enclosed Notice of Violation include, 1) prohibition of further repair activities to the system involved until approved procedures are implemented, 2) further evaluation of personnel exposures, and

3) providing additional formal guidance to your staff about reporting requirements.

AUG 2 2 ~1980 Power Authority of the State of New York-Accordingly, we propose civil penalties in the amount of Twelve Thousand Dollars for the items of noncompliance described in Appendix A.'

Appendix B to this letter is the Notice of Proposed Imposition of Civil Penalties.

In preparing your. response, you should follow the instruct. ions in Appendices A and B.

Your written reply to the Notice of Violation combined with the finding's from our continuing inspections of your licensed activities will be considered in determining whether any further enforcement action, such as modification,

. suspension or revocation of your license, is appropriate.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter will be placed in the NRC's Public Document Room.
