responds to the June 30, 1980 memorandum concerning the TMI Review Item Schedule. Based on our review of the combined applicant, State and local emergency plans, we conclude that the current plan provides an acceptable state of emergency preparedness for a fuel load and low power testing license.

We have reviewed the applicant's emergency plar. for a fuel load and low power license. For this license, we required that the combined applicant, State and y

local emergency plans must meet:

Regulatory Position Statements in Regulatory Guide 1.101 (March 1977).

c.

Essential planning elements in NUREG 75/111 and Supplement I thereto.

d.

Additional requirements or "TMI-Related Requirements for New Operating Licensees". NUREG-0694 (June 1980).

We have reviewed the combined applicant, State and local emergency plans against these criteria and our finding is summarized below.

The applicant submitted a plan for coping with emergencies at McGuire Nuclear Station Units 1 and 2 dated February 1976. We reported on the applicant's emer-

gency plan in the Safety Evaluation Report dated March 1978 and Supplement No. 2

to the report and determined that the applicant's emergency plan met the requirement of Appendix E to 10 CFR Part 50 and provided an adequate basis for an acceptable state of emergency preparedness.

g The applicant's emergency plan includes provisions for coping with emergencies within the boundary and in the environs of the plant site. Responsibility for planning and implementing all emergency measures within the site boundaries rests with the licensee. The planning and implementation of measures to cope with clant-related emergencies outside the site boundary are a coordinated effort involving

the applicant and local, State and Federal agencies having emergency responsibilitie The emergency plan describes the coordination of the arrangements and agreements between the licensee and these agencies. Provisions have been made for an annual review of the emergency plan and for periodic testing and updating, including procedures, based on training, drills, and exercises. The scope and centent of l

in Annex A, " Organization and Content of Emergency Plans for Nuclear Pcwer Plants,"

to Regulatory Guide 1.101.

We also conclude that it meets tne regulatory position statements of Regulatory Guide 1.101.

i As a result of the Commission's action plan for Promptly Upgrading Emergency

Preparedness at Power Reactors (SECY 79-450), the applicant submitted on March 20, 1980, a proposed revision to the McGuire Nuclear Station Emergency Plan. This proposed revised plan was reviewed by the Staff and the Emergency y

Planning Review Team conducted a site visit and. technical meeting with the i

applicant. Our preliminary review reflects that.the licensee has designated i

an interim Emergency Operations Facility, estabi.shed an interim Technical

~

Support Center, and designated an onsite Operations Support Center which we find meets the requirements of NUREG-0694 for the issuance of this license.

The North Carolina Radiological Emergency Response Plan was reviewed by the Federal Emergency Management Agency against the guideline standards of the Nuclear Regulatory Commission's " Guide and Checklist for Development and Evaluation of State and Local Government Radiolacical Emergency Response Plans in Support of Fixed Nuclear Facilities," (NUREG 75-111) including Supplement No. 1 to that publication dated March 15, 1977, and concluded that the current North Carolina emergency preparedness, including the local governments surrounding the McGuire plant, covers all elements of the criteria. Current planning by the State against NUREG-C654/ FEMA REP-1 is at least 95% complete.

In summary, based on our review of the combined applicant, State and local emergency plans, we conclude that the current plan provides an acceptable state of emergency preparedness for a fuel load and low power license.

JEFICIENCIES TO BE CORRECTED FOR A FULL POWER LICENSE

urrent efforts by the staff, the Ccamission and FEMA to upgrade rules and
uidance in the area of emergency planning will result in definitive and
niform acceotance criteria in the near future.

In the meantime, the NRR staff has informed LWR applicants anc licensees of its new requirements in emergency planning via various letters and orders. Highlights of these current staff requirements yet to be accommocated in the emergency plans for the appli-cant are:

1.

Demonstration of preparedness to cope with a full spectrum of accidents as outlined in NUREG-0396.

2.

Promote means to notify the public witnin 10 miles of the station (i.e., within 15 minutes).

3.

A commitment to and a descripticn of the miniraum staffing requirements for on-shift and support personnel.

A commitment to and a description of the Meteorological Criteria for emergency preparedness.

(See Ap;endix 2 to NUREG-0654)
