PREHEARING CONFERENCE ORDER AND ORDER SETTING TIME FOR DISCOVERY (September 9,1980)
A Prehearing Conference was held in this matter on June 28, 1980 in Peoria, Illinois.
Among a number of matters considered at this Prehearing Con-ference were the issues to be litigated during the hearings in this proceeding.
The Board requested the parties to file in writing what each considered such issues to be.
Responses to this request have been filed by the Applicant, Nuclear Engineer-ing Company (NECO), the Nuclear Regulatory Coc:nission Staff (Staff),
and the State of Illinois (State).
The Board has considered the various proposals by the parties and determines that the issues are the following:

'l.-~Whether the Applicant " possesses" the source, byproduct or.special nuclear material at the Sheffield site.

Whether NECO can unilaterally terminate License No. 13-10042-01 for. activities at Sheffield without affirmative action by the Commission.
3.
If-NECO cannot terminate its license without affirmative action.by the Commission, what conditions, if any, are appropriate to impose in order to protect the public health and safety as well as the environment before NECO may quit the site.
These three issues will permit a full litigation of the matters which are the subj ect of this proceeding.
Discovery on these issues will proceed as follows:
1.
All requests for discovery shall be made by the parties on or before October 10, 1980.

All obj ections to discovery' shall be filed by October 20, 1980.
3.
All responses to discovery requests shall be made by November 1, 1980.
4.
Motions to compel discovery shall be filed by November-15, 1980.

The Board will set a date for filing motions for sumary disposition at the completion of discovery.
