ISSUANCE OF OPERATING LICENSE FOR CALLAWAY COUNTY NUCLEAR POWER PLANT OWNED BY UNION ELECTRIC OF ST. LOUIS, MISSOURI Gentlemen; Reference issuance of an operating license for the Callaway County Nuclear Power Plant owned by Union Electric of St. Louis, Missouri.

Under the provisions of NUREG-0654/ FEMA-1, NUREG 0396; EPA 520/1-78-016 and other pertinent US NRC publications, funding for local support of commercial nuclear power plants has not been addressed.

The last study was done by Doctor Stephen N. Solomon (NUREG 0553).

He presented a logical approach to the matter and a reasonable solution to the problem (see PART III PREFERRED APPROACH-NUREG 0553).

l The NRC does not now have legal authority to impose fees on applicants or licensees, so legislation will be necessary if Dr. Solomon's plan is to implemented.

The NRC does have licensing authority, and no operational license should be issued until an " adequate," locally controlled program of safety is in existence and operationally effective.

This provides the local populace with a " reasonable" degree of l

protection from Class 9 accidents, should they occur.

1 ihe Three Mile Island incident was indicative that local and state nuclear safety capabilities were non-existent or ineffective.

No official appeared to know what was going on or how to react.

It resulted in a loss of credibility so huge that today no one believes the NRC or utility owners concerning any safety matter.

There is'no need for confusion or disharmony on the matter of public safety.

We can live with nuclear technology, but must accept the responsibility and costs incurred.

The responsitility for safe operations rests with the utility and the costs for local and state emergency response is the inherent

" insurance fee'.' that the utility must pay.

Only the utility has the built-in capability for re-couping these expenses.

We respectfully petition the United States Nuclear Regulatory Commission to withhold issuance of an operating license on the Union Electric Nuclear Power Plant which is located at Reform in Callaway County, Missouri,.until an adequate local emergency response capability has been planned, funded and operationally effective.
