STATE OF MICHIGAN DEPARTMENT OF ATTORNEY GENERAL P.O. BOX 30755 LANSING, MICHIGAN 48909 DANA NESSEL ATTORNEY GENERAL December 3, 2019 U.S. Nuclear Regulatory Commission Office of Nuclear Material Safety and Safeguards Washington, DC 20555-0001
Dear Commissioners,
Thank you for hosting the August 21st public meeting near the Palisades Nuclear Power Plant seeking stakeholder input on best practices for establishing and operating local community advisory boards to foster communication and information exchange between a decommissioning licensee and the local community. As your representatives explained at the meeting, the Nuclear Energy Innovation and Modernization Act (NEIMA) requires the Nuclear Regulatory Commission (NRC) to provide a report to Congress identifying these best practices.
As announced by Entergy Corporation, the owner of the Palisades Nuclear Power Plant, it is planning to shutdown Palisades sometime in the spring of 2022. The decommissioning of Palisades and the storage and/or removal of its spent nuclear fuel is critically important to the State of Michigan and its citizens. As their chief consumer advocate, I am committed to ensuring this process protects ratepayers and Michigans environment, and intend to closely monitor this decommissioning and the handling of the spent nuclear fuel.
Accordingly, I believe it is a best practice to include my office, along with other state government officials, in any discussions regarding the decommissioning of Palisades and the creation of any community advisory board. On behalf of all Michigan residents, I thank you for considering this request.
Sincerely, Dana Nessel Michigan Attorney General CC: Sally Talberg, MPSC Chair Liesl Clark, EGLE Department Head
