Dear Mr. McPhillips:

I am writing at the request of Mr. John F. Wolf, Chairman of the Atomic Safety and Licensing Board (Licensing Board) in the above-captioned pro-ceeding, to advise you of the discussions held among the Licensing Board members, Westinghoese Electric Corporation (Applicant), David L. Allred anc the IRC Staff (Staff) in our telephone conference call of October 16, 1980. As you know, although you were advised in advance of the date and time of the conference call, you were away from your telephone when the conference call was placed.

The Licensing Board has approved the parties' and petitioners' joint proposal to meet in Montgomery on November 6-7, 1980,. to continue their attempt to arrive at a stipulation of contentions. We-indicated to the Licensing Board that you and Mr. Allred had undertaken to reformulate the contentions which we already discussed in our meetings of October 7-8, 1980, and that you would forward those reformulations to the Staff and Applicant during the week of October 20, 1980.

The Licensing Board has extended the time in which to file a stipulation of contentions and non-stipulated contentions to December 15, 1980.

It is.

anticipated that following our. meetings of November 6-7, 1980 and prior to the'Docember 15, 1980 filing date,.the parties and petitione:s will discuss and further refine the stipulated and non-stipulated contentions.

Consistent with this extension of time, the State'of Alabama has been granted an axtension until December 15, 1980, in which to file its statement of the subiect matters.'in which it desires to participate. -Similarly, the Staff and Applicant were granted an extension of time until December 15, 1980 in which to file responses to the contentions which were filed by petitioners SEACA and Allred.

' It is anticipated that after the stipulation of contentions and non-stipulated contentions have been filed, a further conference call will be placed to discuss the scheduling of another prehearing conference. The parties and-petitioners are requested to indicate in their filings of December 15, 1980, a suggested date for the prehearing conference. One possible alternative is to schedule the prehearing conference on a date during the month of January,

1981, The Licensing Board reminded the petitioners and the State of the Com-mission's revised procedural assistance rule under which they may wish to reof.est copies of the prehearing conference transcript. Additionally, nr. Allred was requested to advise the Licensing Board of his position concerning an alleged conflict of interest, after he has received and reviewed the recent letter sent to him concerning this question.
