......o September 13, 1976 MEMO TO FILES VERMONT YANKEE AND CONSUMERS POWER CASES This memorandum is written to record informal responses received concerning the telegram sent by the Secretary of the Commission on September 8, 1976, stating that Chairman Rowden would partici-pate in the decision of motions in the above proceedings and inviting the filing of objections thereto.

On the evening of September 8 I returned a telephone call made by Myron M. Cherry, counsel for the intervenors in the Midland proceeding.

He asked for further information regarding the Chairm.an's involvement in the proceeding, and I informed him that the Chairman ha.d no personal recollection of any such par-ticipation, having disqualified himself because of his official responsibility for the case at the time when he was Associate General Counsel of the Atomic Energy Commission.

I stated also that the Chairman felt confident in his ability to decide the issues presented by the motions on their merits.

Mr. Cherry then advised me in light of this conversation and his wish for speedy action on the motions, he would make no objection to Mr. Rowden's participation.

Steve Eilperin of my' office was advised by Thomas Di'gnan, counsel.for the Vermont Yankee Nuclear Power Corporation, that they would have no objection to Chairman Rowden's participation.

Saud'ek of tho Vermont Public Service Board advised the Office,of the Sec.etary of the Commission that the Public Service Board had no objection to the Chairman's participatio'n.

1 This morning, September 13, Anthony Roisman, counsel for the intervenors in the Vermont Yankee case, advised my office by telephone that intervenors in that case would have no objection to Chairman Rowden'.s participation.
