These are proce=petitive committents.
The Department believes their implerentction would serve to preserve and pro =cte competitier. in electric power markets in the Piedmont Ccrolinas.
They would provide electric systems who are no.:
full-requirements wholesale custo=crs of the Applicant accesr i
i to alternative sources of pcwor supply.
Those systems could then chcase to avcil ther '1ves of these arrangements cnd i
enter into the business of producing part or all of their own power supply, or they might seek to buy part er all of their requircrents from other suppliers.
They vould no lorger need to depend on Applicant for their full pcwcr requirements, and i
Appliccnt 's full-requirements wholesale rcte would then ne longer be the sole possible deten, inent of their power nupply costs.
Implementctica of these commitments is consistent with our representatien of the public interest in the cpplication of antitrust law and policy to the licensing of nuclear power plant s under the-Atomic Energy Act.
4 In cecordance with Section 105c(1) cf that Act, t l.2 Departtent had previously advised the.tomic Energy Commission that antitrust hecrings would be required on Duke Power Company's Ocenec, McGuire and Catawba license applications.
In view of Applicant 's undertaking of the instanc cct=ittent s,
however, the Department concluded that our recorrendations for 3

antitrust hearings should be withdrawn, and we so advised Mr. Howard K. Shapar, Associate General Counsel of the Co==ission, in a supplemental letter of advice dated April 26.
1974.
A copy of that letter is also attached hereto.
)
Fursuant to Sectica 2.730 of the Commission's Rules, the d
Department now coves the Atomic Safety and Licensing Board issue an order' directing that the licenses (i.e., operating licenscs and/or construction permits as applicable) for Oconce Units 1, 2 and 3 and McGuire Units 1 and 2 be amended to attcch the ec7.mittents included with Applicant 's April 26, 1974, letter to the Depart =ent as conditions to those licenses. */
The Atemic Energy Cc mission Staff joins in this motien.
Applic an t, pe: its April 26, 1974, letter, has cgreed tb the attach =cnt of these co==itments as conditions to the Oconec and McGuire licenses, while ct the same time reserving the right to oppose the i=positien of any different or cdditional i
conditions by the Board in the event an avidentiary hearing subscquently would occur.
The cunicipal Intervenors have not joined in this notien, and we do not undertake to state their position here.
We 4
note, houever, that our motion does not affect any right those Intervenors may have to an antitrust hearing on the Oconec and McGuire applications, including the right to rOtain any relief to which they may be found entitled-by the Board af ter such a hearing.

m of any difC2 rent or additional license conditions after
- hearing, he Intervenors are free to endeavor to establish that issuance of the Ocence and McGuire licenses would create or umintain a situation inconsistent with the antitrust laws and to seek the imposition of whatever relief they may desirc' following a hearing.
This is no: a cotion for surmary dis-position of the Oconee-McGuire proceedings, the granting cf which would settle the rights of all partics thercin.
SettJc-cent here would be partial, limited to the clai=
cf the AEC staff and the Department for relief against tha.\\pp?icant.
Accordingly, the fundamental question for the Board in determining whether to grant this cetion cust be:
Would atendment of the Ocenes and McGuire licenses to attcch the cgreed-upon license conditions at this time prejudice cny rights of a party who does not choose to agree to these conditions te have its claims heard?
We believe the answer is clearly "no," and we urge the Board to require any party opposing thic cotion to show af ~irmatively hou it would be prejudiced in this proceeding by the ' granting of the motion.
We believe this position is in accord with Secrion 2.759 of the AEC Rules of Practice which states:
The Cc mission receqnizes that the public interest may be served through settlement of particulcr issues in : proceeding er the entire procecding.
Therefore, to the extent that it is not inecnsistent with _ hearing require =ents in section 189 of the Act (42 U.S.C. 2239), the fair and reason.cble 5

settlement of contested initial licensinc proceedings is encourcsed.
It is expected that the presidine officer and all of the parties 'o those proceedings will take appropriate steps to carry out this purpose.
The granting of our motien would terminate the prosecu-tion-! role of.the AEC staff and the Department in this proceeding; we would neither present evidence nor seek the l
imposition of any different er adcitional license conditions by the Eccrd.
Heuever, because of our statutory responsibili-ties in the administration and coforcement of Section 103c of the Atom:c Energy Acc and because this is one cf the initial proceedings under th:t section, so long as th' proceeding remains pending and it is uncertain whct issues may arise.
l we belic"=
4-becessary thct the AEC staff and the Department t
l remain parties in the proceeding so thct our vitws may be l
made known to the Board if. appropriate.
The rcles of Applicant
(
and Intervenors in the proceeding would, of course, remain unchanged.
We strongly urge the granting of this motien.
Respectfully submitted, n pl w I '.. l; q,.,, ',
